Standard Terms and Conditions of Pool Service, Maintenance, and Subscription Offerings

Applicable to Residential and Commercial Customers

By receiving or paying any invoice from us, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

1. What We Do – Weekly/Monthly Service (Included in Monthly Rate)

During each scheduled service visit we will, as needed:

  • Perform expert chemical testing with industry-leading digital equipment and balance the water.
  • Record and track all chemical readings.
  • Empty skimmer baskets, pump baskets, and leaf canisters (if present).
  • Brush walls, steps, benches, and waterline tile.
  • Vacuum the pool floor.
  • Net the surface.
  • Backwash or recharge filters as needed.
  • Visually inspect and monitor equipment operation.

Time on Site

  • Residential: Up to 30 minutes.
  • Commercial: As needed.

2. Service Frequency & Schedule

  • Minimum of 48 visits per year (average of at least 4 visits per month).
  • Service days may be adjusted with advance notice, or without notice in the event of labor shortages or immediate business needs.
  • Full cleaning is not performed during rain. If safe, we will provide chemical testing, balancing, and basket emptying only. If unsafe, the visit will not occur and will not be made up.
  • We are closed on Memorial Day, Independence Day, Labor Day, Thursday through Sunday of Thanksgiving week, and December 25 through January 1.
  • Two non-consecutive technician vacation weeks per year (typically autumn/winter); total annual visits remain unchanged.

3. Additional Services (Billed Separately at Then-Current Rates)

The following are required and billed add-on services:

  • Filter cleaning (cartridge, DE, or sand).
  • Salt cell cleaning (if applicable).
  • Conditioner/stabilizer additions.
  • Chlorine tablet loading or specialty chemical treatments.
  • Phosphate remover, clarifiers, scale inhibitors, etc.
  • Spa drain-and-refill (commercial accounts – minimum 4× per year or as required by health department).
  • Annual specialty chemical costs.
  • Any replacement parts or repairs.

4. Repairs & Replacement Parts

Minor wear-and-tear items (baskets, o-rings, weir doors, gauges, etc.) and any required repairs will be performed at then-current pricing for parts and labor.

In the event of repairs, emergency situations, hazards, or other issues identified with the pool or its equipment, you must immediately cease use of the pool and prevent access until the issue is fully resolved and confirmed safe in writing. We are not liable for injuries, damages, or losses arising from continued use while the pool is under repair or malfunctioning.

5. Customer Responsibilities (Critical for Service)

  • Maintain water level at mid-skimmer at all times (we do not add or remove water).
  • Ensure gates are unlocked and latches function properly on service day.
  • Keep equipment areas and decks clear of debris, pet waste, toys, furniture, and vegetation.
  • Remove solar covers/blankets before service.
  • Clear standing water from automatic covers before service.
  • Provide safe access and working conditions for technicians.

Failure to meet these responsibilities may result in partial service and/or trip charges. Failure to follow company recommendations may result in deterioration of equipment or surfaces, and the company will not be responsible for such outcomes.

6. Billing & Payment

  • Invoices are issued monthly.
  • Automatic credit/debit card billing is available — no paper invoices or checks required.
  • Payment is due upon receipt.
  • Late payments are subject to a late fee.
  • Returned payments incur a return fee.
  • Invoices unpaid past 60 days will result in pause or cancellation of service.

7. Limited Warranty and Disclaimer

AC POOLS SHALL PROVIDE SERVICES IN A TIMELY AND PROFESSIONAL MANNER CONSISTENT WITH INDUSTRY STANDARDS. AC POOLS’ SOLE LIABILITY, AND YOUR SOLE REMEDY, FOR BREACH OF THIS WARRANTY SHALL BE THE REPERFORMANCE OF NON-CONFORMING SERVICES.

EXCEPT AS EXPRESSLY PROVIDED HEREIN AND TO THE FULLEST EXTENT PERMITTED BY LAW, AC POOLS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

8. Limitations of Liability

  • We are not responsible for pre-existing equipment failures, code violations, or construction defects.
  • Natural calcium or scale buildup is not covered under routine service.
  • Commercial pools without automation may incur additional fees if shut down by health authorities.
  • Liability is limited to the greater of fees paid in the preceding 12 months or fees paid for the specific service.
  • Our aggregate liability shall not exceed applicable insurance limits.
  • We are not responsible for ensuring code compliance unless agreed in writing.
  • We do not inspect or maintain signage or non-essential pool accessories unless explicitly included.
  • We are not liable for indirect, incidental, or consequential damages.

You agree to indemnify and hold us harmless from claims arising from failure to comply with these Terms or unsafe conditions at your property.

IN THE EVENT OF ANY CLAIM, YOU AGREE TO BRING CLAIMS ONLY ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS OR REPRESENTATIVE ACTION.

9. Term & Termination

  • Service continues month-to-month.
  • Either party may terminate with 14 days’ written notice.
  • Monthly rate increases will be communicated at least 30 days in advance.
  • Prices for chemicals, add-ons, and repairs are subject to change without notice.
